Defending Care Providers, Protecting Older Adults

The conversation began with one of today’s fastest-growing threats: financial scams against older adults. With advances in AI making it possible to mimic voices and images, families must take proactive steps to protect loved ones.

Tips discussed on the show:

  • Create a family code word for emergencies.

  • Slow down and verify before sending money.

  • Look to trusted sources like the Attorney General’s office, AARP, and the Alzheimer’s Association for current scam alerts.

Falls and the Power of Documentation

Most legal claims Sheston encounters in senior care involve falls. While not always preventable, facilities can reduce risk through layered prevention strategies and by leveraging new technology that predicts when someone is at higher risk.

Equally important, Sheston emphasized the need to document successes not just incidents. In one memorable case, staff prevented hundreds of falls that never made it into the chart. When only negative events are recorded, juries see an incomplete story.

“Be intentional about the information you’re putting in the record,” Sheston said. “Think about how those words could look on a screen in front of a jury.”
